1. ACCEPTANCE OF TERMS

By accessing and using Emhash ("the App"), you accept and agree to be bound by these Terms and Conditions and End User License Agreement (EULA). If you do not agree to these terms, you must not use the App.

This agreement constitutes a legally binding contract between you and Emhash. You acknowledge that you have read, understood, and agree to be bound by all provisions herein.

2. ZERO TOLERANCE POLICY FOR OBJECTIONABLE CONTENT

EMHASH MAINTAINS A STRICT ZERO TOLERANCE POLICY FOR OBJECTIONABLE CONTENT AND ABUSIVE BEHAVIOR.

We absolutely prohibit and will immediately remove:

• Profanity, obscene, or vulgar language
• Sexually explicit content or nudity
• Hate speech, discrimination, or racist content
• Harassment, bullying, or threats
• Violence, gore, or graphic content
• Content promoting self-harm or suicide
• Illegal activities or drug-related content
• Spam, scams, or fraudulent content
• Misinformation or harmful false claims
• Child exploitation or endangerment (any form)
• Content that violates others' privacy or rights

ENFORCEMENT:

• Content will be removed immediately upon detection
• Users posting objectionable content will face immediate consequences
• No warnings will be given for severe violations
• Accounts may be permanently banned without prior notice
• We reserve the right to report illegal content to authorities

By using Emhash, you agree that you will NOT post, share, or engage with any objectionable content.

3. ZERO TOLERANCE POLICY FOR ABUSIVE USERS

EMHASH MAINTAINS A STRICT ZERO TOLERANCE POLICY FOR ABUSIVE USERS AND BEHAVIOR.

Abusive behavior includes, but is not limited to:

• Harassment, stalking, or intimidation of other users
• Bullying, threatening, or violent behavior
• Hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Impersonation or identity theft
• Doxxing or sharing others' private information
• Coordinated attacks or brigading
• Creating multiple accounts to evade bans
• Manipulating or gaming the system
• Exploiting vulnerabilities or bugs
• Any behavior that creates a hostile environment

ENFORCEMENT:

• Abusive users will be immediately suspended or permanently banned
• Severe violations result in instant permanent ban
• No appeals for users engaging in severe abuse
• We cooperate with law enforcement for illegal activities
• Banned users cannot create new accounts

We are committed to maintaining a safe, respectful community. Abusive users have no place on Emhash.

4. AGE REQUIREMENT

You must be at least 18 years old to use Emhash. By using the App, you confirm that you meet this age requirement.

We do not knowingly collect information from or permit use by anyone under 18. If we discover underage users, their accounts will be immediately terminated.

5. LICENSE GRANT

Subject to your compliance with these terms, Emhash grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device(s)
• Use the App for personal, non-commercial purposes only
• Access and use the App's features in accordance with these terms

This license does NOT grant you any ownership rights to the App. All rights not expressly granted are reserved by Emhash.

6. LICENSE RESTRICTIONS

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Use the App for any commercial purpose
• Use automated systems (bots, scrapers) to access the App
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use the App to violate any laws or regulations

7. USER CONDUCT

You agree to:

• Use the App in a respectful and lawful manner
• Not post content that is offensive, abusive, or violates others' rights
• Not engage in harassment, bullying, or hate speech
• Not spam or post repetitive content
• Not impersonate others or create fake accounts
• Not share content that promotes violence or self-harm
• Not violate any applicable laws or regulations

8. REPORTING OBJECTIONABLE CONTENT AND ABUSIVE USERS

We provide in-app reporting mechanisms to report:

• Objectionable content
• Abusive users
• Policy violations
• Illegal activities

How to Report:

• Tap the report icon on any signal or user profile
• Select the violation type
• Provide details (optional)
• Submit report

Our Response:

• Reports are reviewed within 24 hours
• Violating content is removed immediately
• Violating users are suspended or banned
• Reporters are notified of actions taken
• Serious violations are reported to authorities

9. CONTENT MODERATION

Emhash employs multiple layers of content moderation:

• Automated filtering for prohibited content
• User reporting system
• Manual review by moderation team
• AI-powered content detection

We actively monitor and remove:

• All forms of objectionable content
• Abusive user behavior
• Policy violations
• Illegal content

Moderation is ongoing 24/7 to maintain a safe community.

10. VIOLATIONS AND ENFORCEMENT

Violation System:

• 1st-2nd Violation: Warning, content removed
• 3rd Violation: 7-day account suspension
• Multiple Suspensions: Permanent account ban (blocklist)

SEVERE VIOLATIONS (Immediate Permanent Ban):

• Child exploitation or endangerment
• Sexually explicit content
• Hate speech or discrimination
• Threats of violence
• Illegal activities
• Harassment or stalking

We reserve the right to:

• Remove content that violates these terms
• Suspend or terminate accounts immediately
• Report illegal activities to law enforcement
• Take legal action against violators

11. ACCOUNT SUSPENSION

Suspended accounts:

• Cannot post signals
• Cannot interact with other users
• Cannot send messages or reactions
• Duration: 7 days from suspension date
• Violations are cleared after suspension period

12. PERMANENT BAN (BLOCKLIST)

Accounts may be permanently banned for:

• Repeated violations (3+ suspensions)
• Severe violations of terms
• Abusive behavior
• Illegal activities
• Posting objectionable content

Banned users:

• Cannot login to the platform
• Cannot create new accounts with the same email
• May appeal ONLY for non-severe violations by contacting hello@emhash.com
• No appeals for severe violations (child exploitation, illegal content, etc.)

13. PRIVACY AND DATA

Your privacy is important. Please review our Privacy Policy for details on:

• Data collection and usage
• Location data handling
• Third-party services
• Your rights under GDPR

14. CONTENT OWNERSHIP AND INTELLECTUAL PROPERTY

Ownership:

• The App, including all code, design, graphics, and content, is owned by Emhash
• All trademarks, logos, and service marks are property of Emhash
• This license does NOT transfer any ownership rights to you

User Content:

• You retain ownership of content you create and post
• By posting content, you grant Emhash a worldwide, non-exclusive license to use, display, and distribute your content within the App
• The right to moderate or remove content
• The right to use anonymized data for analytics
• This license terminates when you delete your content or account

15. CONTENT RETENTION

• Signals disappear from map after 24 hours
• Content stored in history for 6 months
• Deleted accounts: all data permanently removed
• Analytics data: retained up to 24 months (anonymized)

16. WARRANTY DISCLAIMER

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Emhash DISCLAIMS ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation
• Security or freedom from viruses

We do NOT guarantee:

• The App will meet your requirements
• The App will be available at all times
• Errors will be corrected
• Results obtained from the App will be accurate
• User-generated content is accurate
• The App provides medical or mental health services

17. MENTAL HEALTH DISCLAIMER

Emhash is NOT a substitute for professional mental health care. If you are experiencing:

• Suicidal thoughts
• Severe depression or anxiety
• Mental health crisis

Please contact:

• Emergency services (911 or local equivalent)
• National Suicide Prevention Lifeline
• Mental health professionals

18. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Emhash SHALL NOT BE LIABLE FOR:

• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or use
• Business interruption
• Personal injury or emotional distress
• User-generated content
• Third-party actions or content
• Damages arising from objectionable content posted by users
• Damages arising from abusive user behavior

MAXIMUM LIABILITY:

If liability is found, our total liability shall not exceed $100 USD or the amount you paid to use the App (whichever is greater).

19. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Emhash, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your content
• Your violation of these terms
• Your violation of others' rights
• Your posting of objectionable content
• Your abusive behavior toward other users

20. UPDATES AND MODIFICATIONS

App Updates:

• We may release updates, patches, or new versions
• Updates may be automatic or require manual installation
• Continued use after updates constitutes acceptance

Terms Updates:

• We reserve the right to modify these terms at any time
• You will be notified of significant changes
• Continued use after changes constitutes acceptance of new terms

21. TERMINATION

This license is effective until terminated.

Termination by You:

• Delete the App from your device
• Delete your account through App settings

Termination by Emhash:

• For violations of these terms
• For posting objectionable content
• For abusive behavior
• At our sole discretion
• With or without prior notice

Upon termination:

• Your license to use the App ends immediately
• You must delete the App from all devices
• Your account and data may be deleted
• Provisions regarding ownership, disclaimers, and liability survive termination

22. DISPUTE RESOLUTION

Informal Resolution:

• Before filing a claim, contact us at hello@emhash.com
• We will attempt to resolve disputes informally

Arbitration:

• Disputes shall be resolved through binding arbitration
• You waive the right to a jury trial
• You waive the right to participate in class actions

Exceptions:

• Small claims court disputes
• Intellectual property disputes
• Injunctive relief requests

23. GOVERNING LAW

These terms are governed by the laws of the jurisdiction where Emhash operates, without regard to conflict of law principles.

For users in specific regions:

• EU users: GDPR and local consumer protection laws apply
• California users: CCPA and California consumer laws apply
• Other regions: Local mandatory consumer protection laws apply

24. THIRD-PARTY SERVICES

The App integrates with third-party services:

• Google Sign-In (authentication)
• Apple Sign-In (authentication)
• Google AdMob (advertising)
• Firebase (analytics and infrastructure)
• AWS S3 (cloud storage)

These services have their own terms and privacy policies. Emhash is not responsible for third-party services.
